Curbmatic LLC – Membership Terms & Conditions of Service

Membership Requirement

All Curbmatic customers are members and must select and maintain an active membership plan to receive services. Services are available only while membership remains active and in good standing.

Home Access Authorization

Customer grants Curbmatic LLC and its independent contractor's permission to access the exterior areas of the property solely for the purpose of providing bin placement services. Access is limited to visible, unobstructed exterior areas only.

Scope of Service

Curbmatic provides scheduled movement of customer trash and recycling bins to the curb and back on designated municipal collection days.
Curbmatic does not remove, haul, or dispose of trash.

Bin Accessibility Requirements

Bins must be accessible and free of obstructions, including but not limited to:

• Locked gates
  
  

• Parked vehicles
  
  

• Snow, debris, or other barriers
  
  

Failure to provide access may result in a missed service without refund or credit.

Pricing & Membership Fees

Pricing is determined by membership plan, service frequency, and property type.
All fees are subject to applicable taxes and regulatory charges.

Price Changes

Curbmatic reserves the right to modify pricing with thirty (30) days written notice, provided via email or website posting.

Billing & Payment Terms

• Services are billed quarterly in advance
  
  

• Membership fees are non-refundable
  
  

• Accepted payment methods must remain valid and current
  
  

Failure to pay may result in immediate suspension or termination of service.

Automatic Renewal

Memberships automatically renew at the end of each billing cycle unless canceled at least fourteen (14) days prior to renewal.

Free Trial

New members receive a 14-day free trial.
If not canceled before the trial ends, the membership converts automatically to paid quarterly billing.

Pets & Safety

Customer must secure all pets during service hours.
Curbmatic assumes no liability for incidents involving unsecured or aggressive animals.

Vehicle Clearance

Customer must ensure driveways, walkways, and bin paths remain clear during scheduled service windows.

Garage Access (If Applicable)

If garage access is provided, customer authorizes Curbmatic to open and close the garage solely for bin service purposes.

Safety Conditions

Curbmatic reserves the right to refuse or delay service due to unsafe conditions including:

• Aggressive animals
  
  

• Ice or severe weather
  
  

• Poor lighting
  
  

• Environmental hazards
  
  

Bin Condition

• Lids must fully close
  
  

• Overfilled, overflowing, or damaged bins may not be serviced
  
  

• Scattered or loose trash will not be handled
  
  

Customer remains responsible for bin condition and cleanliness.

Weather & Municipal Disruptions

Service may be delayed or canceled due to:

• Severe weather
  
  

• Road closures
  
  

• Municipal service changes
  
  

Service will resume on the next scheduled service day.

Short-Term Rental & Multi-Unit Properties

Property owner or account holder remains financially responsible for service regardless of tenant changes or occupancy.

Technology Limitations

Curbmatic is not responsible for service disruptions caused by:

• Internet outages
  
  

• Mobile carrier failures
  
  

• Software or platform downtime
  
  

Holidays

Collection schedules may shift due to holidays. Notice will be provided in advance when possible.

Customer Support & Complaints

All service concerns must be submitted in writing within seven (7) days of the service date.

Limitation of Liability

Curbmatic’s total liability is limited to the amount paid for the affected billing period.
Curbmatic is not liable for incidental, indirect, or consequential damages.

Disclaimer

Services are provided “as is”, without warranties of any kind, express or implied.

Right to Refuse Service

Curbmatic reserves the right to refuse, suspend, or terminate service at any time for any lawful reason.

Arbitration & Governing Law (Multi-State Enforceable)

Arbitration. Any dispute, claim, or controversy arising out of or relating to this Agreement or the services provided by Curbmatic LLC shall be resolved exclusively through binding arbitration, administered in accordance with the rules of the American Arbitration Association.

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles, regardless of the state in which services are performed or the customer is located.

Waiver of Jury Trial. Customer knowingly and voluntarily waives any right to a trial by jury in any action or proceeding arising from this Agreement.

Nationwide Applicability. This arbitration provision applies to all customers and services provided by Curbmatic LLC in any state or jurisdiction in which Curbmatic operates, to the fullest extent permitted by law.

Electronic Acceptance

Electronic acceptance, account creation, or payment constitutes a legally binding agreement to these terms.

Messaging & Communications

By providing contact information, customer consents to receive service-related communications via SMS or email.

Privacy

Customer data is used solely for service delivery and communication in accordance with Curbmatic’s Privacy Policy.

Entire Agreement

These Terms & Conditions constitute the entire agreement and supersede all prior communications or agreements.
